These Terms of Use are an agreement between you and Fijara LLC, which runs ChalkSpin, a Tayari Labs product, about using chalkspin.com and its tools. By using ChalkSpin you agree to them. If you don't agree, please don't use the site.
Our Privacy Policy, Cookie Policy, Refund Policy and Copyright Policy are part of these terms.
Who can use ChalkSpin
ChalkSpin is made for adults: teachers, trainers, hosts and families. The free tools work without an account. Accounts are only for adults 18 and over, and there are no student accounts. Teachers and parents may use and display the tools with the children in their care, for example on a classroom projector.
If you use ChalkSpin for a school or organization, you confirm you're allowed to accept these terms for that use.
Your account
- Give a real email address you can receive mail at, and keep access to it secure. Sign-in links are personal: don't forward them.
- You're responsible for what happens in your account. Tell us at once at support@chalkspin.com if you think someone else is using it.
- You can delete your account at any time in Account settings. What happens to Pro and credits when you do is in the Refund Policy.
Your content
The entries, lists, wheel titles and images you add stay yours. To run the service you give us permission to store, copy and display them only as needed to provide ChalkSpin to you and to the people you share them with (for example, showing your wheel to someone who opens your share link). This permission ends when you delete the content, except for copies in backups, which expire within 35 days.
Anyone with a share link can see what's on that wheel, so don't put sensitive personal information on a shared wheel. For students, first names or initials are usually enough.
Acceptable use
Please don't use ChalkSpin to:
- break the law or help anyone else break it;
- harass, bully, threaten or demean anyone, or share hateful, sexual or violent content;
- run gambling, paid lotteries or any game where people pay to win money or prizes (raffle rules vary by state; ChalkSpin only picks);
- share other people's private information, or content you don't have the right to share;
- scrape the site, overload it, probe it for weaknesses, or get around limits, credits or Pro features;
- create accounts in bulk or with automated tools, or pretend to be someone else;
- click our ads yourself or ask others to click them.
We may remove content or suspend accounts that break these rules, and we'll tell you why when we can.
Pro and bingo credits
Pro is a subscription, billed monthly or yearly at the price shown on the pricing page when you buy. It renews automatically until you cancel. You can cancel any time in the Stripe Customer Portal (Account, then Billing); Pro then runs to the end of the period you've paid for and doesn't renew. Nothing you've saved is deleted when Pro ends.
Bingo credit packs are one-time purchases. Credits are valid for 12 months from purchase, can only be used on ChalkSpin, have no cash value and can't be transferred.
Payments are processed by Stripe. Prices may not include sales tax where it applies. If we change Pro prices, the new price applies to new subscriptions; an active subscription keeps the price it started with. Refunds follow the Refund Policy (on request within 14 days of a charge).
Ads and sponsored content
ChalkSpin shows ads, mostly from Google AdSense, and occasionally sponsored templates from brands, always labelled "Advertisement" or "Sponsored". We don't endorse advertisers, and their products and websites are their responsibility. Pro members see no ads.
Our content and the ChalkSpin name
The ChalkSpin name, logo, design, code, templates and guides belong to us or our licensors. You may use the tools and templates in your teaching, at home and in your streams, and print what you make (such as bingo cards) for your own groups. Please don't copy the site or resell its templates as your own.
Random results
Our tools use your browser's cryptographic random number generator (see How the randomness works). Results are for classroom routines, games and everyday decisions. Don't rely on ChalkSpin for decisions with legal or financial consequences, such as official prize draws, and check any rules that apply to your raffle or giveaway.
No warranty
We work hard to keep ChalkSpin fast, fair and available, but it's provided "as is" and "as available". To the fullest extent the law allows, we don't promise it will always be uninterrupted or error-free, and we may change or retire features. Nothing in these terms limits rights you have under consumer law that can't be limited.
Limits on liability
To the fullest extent the law allows, ChalkSpin and Tayari Labs aren't liable for indirect or consequential losses (such as lost profits or lost data), and our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not apply to you.
Ending your use
You can stop using ChalkSpin and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, or if the law requires it. If we close a paid account without a good reason related to your conduct, we'll refund the unused part of what you paid.
Governing law and disputes
These terms are governed by the laws of the United States and the State of Oregon, without regard to conflict-of-law rules. Please contact us first at support@chalkspin.com; most problems are solved quickly that way. If you live in the EU or UK, you also keep the protection of your local consumer laws and can bring claims in your local courts.
Changes to these terms
We may update these terms as ChalkSpin changes. We'll update the date at the top and, for important changes, tell account holders by email or on the site before they take effect. If you keep using ChalkSpin after that, the new terms apply.
